Terms and Conditions of Sale

Revised version · updated 15 October 2026

Preamble

LUBIN markets luxury perfumery products under the “LUBIN” brand, in France and throughout the rest of the world, through a selective distribution network and in its own boutiques under the “LUBIN” name.

The selective network of points of sale authorised to sell LUBIN products at retail, the LUBIN boutique in Paris, and any other LUBIN boutique that may open, are liable to offer a different selection from that sold online by LUBIN on the Website (as defined below).

Through the Website, LUBIN intends to provide commercial information about its products and to enable consumers residing in the countries of delivery listed in article III.6 to purchase them directly.

The purpose of these General Terms and Conditions is to govern all relations between LUBIN and the User (as defined below), in particular the use of the Website and the online sale of Products from the Website.

Please read the General Terms of Use carefully before browsing the Website, and then the General Terms and Conditions of Sale before placing an order, to make sure that you accept them without reservation.

I. Definitions

The definitions below apply to all of the General Terms and Conditions. They apply in both the singular and the plural and, where applicable, to their other grammatical forms.

  • “Customer” means the User who purchases a Product online. A Customer is in fact a User and is therefore subject to the provisions applicable to Users.
  • “General Terms and Conditions” means, together or separately, the Preamble, the Definitions, the General Terms of Use and the General Terms and Conditions of Sale.
  • “General Terms of Use” means the terms and conditions governing access to and use of the Website, set out in part “II. General Terms of Use”. The Preamble and part “I. Definitions” also apply to them.
  • “General Terms and Conditions of Sale” means the terms and conditions for the sale of the Products through the Website, set out in part “III. General Terms and Conditions of Sale”. The Preamble, part “I. Definitions” and part “II. General Terms of Use” also apply to them.
  • “Bank Details” means the information relating to means of payment entered by the Customer when purchasing a Product on the Website.
  • “LUBIN” means LUBIN SARL, a company with a share capital of €1,000,000, registered with the Paris Trade and Companies Register (RCS) under number 478 006 042, whose registered office is at 3 rue du Roule, 75001 Paris, France.
  • “Party” means, separately or together, LUBIN and the User or the Customer, as the case may be.
  • “Product” means the LUBIN-branded perfumery products offered for sale on the Website.
  • “Service” means the distance selling of Products to consumers residing in the countries of delivery listed in article III.6, together with the associated services: creation of and login to a customer account, placing and tracking of orders, payment and delivery of the Products.
  • “Website” means LUBIN’s entire corporate and e-commerce website, presenting information about LUBIN and enabling the retail sale of the Products. The Website is accessible in particular at https://www.lubin.eu. This address is not exclusive and may be changed at LUBIN’s discretion.
  • “User” means any natural person, including Customers, who uses all or part of the features of the Website or the Services (in particular visiting the Website, creating an account and logging in, sending questions or comments), excluding any professional acting in that capacity on their own behalf or on behalf of third parties, such as a wholesaler or a reseller.

II. General Terms of Use

1. Access to and use of the Website

The information about LUBIN and the Products on the Website is accessible to the User, subject to the User’s acceptance of the General Terms of Use. Exchanges between the User and LUBIN via the Website’s contact form are also governed by the General Terms of Use.

Use of the Website does not entail any obligation to purchase.

The Website may only be used for lawful purposes. Any use contrary to a local, national or international law or regulation, or any use that is malicious by its nature or purpose, is prohibited.

The information provided by the User to LUBIN, in particular information relating to their identity, must be accurate and up to date and must not infringe the rights of third parties or any rule of law in force.

2. Website content

LUBIN is not responsible for the content of third-party websites to which the Website links, nor of third-party websites containing a link to the Website.

Questions and comments from Users, whether made public or not, are considered non-confidential. LUBIN may delete them, or use, reproduce or disseminate them, in particular for commercial purposes, after removing any element allowing their author to be identified.

3. Website integrity

The User undertakes not to damage, or attempt to damage, the Website, the equipment, networks and software used to operate it, or the equipment, networks and software of third parties accessible through it.

In particular, sending, receiving, transferring or downloading unlawful content or content liable to undermine the integrity of the Website is prohibited, especially unsolicited advertising messages, viruses and any other malicious program.

4. Processing of personal data

4.1 – Data controller

The personal data collected on the Website is processed by LUBIN SARL, 3 rue du Roule, 75001 Paris, France, as data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and the amended French Act no. 78-17 of 6 January 1978 known as the loi “Informatique et Libertés”.

4.2 – Purposes and legal bases

The data is processed for the following purposes:

  • management of User accounts, orders, payments, deliveries, returns, withdrawals and customer service, on the basis of the performance of the contract concluded with the User;
  • compliance with LUBIN’s accounting, tax and legal obligations, on the basis of a legal obligation;
  • fraud prevention, Website security and management of any disputes, on the basis of LUBIN’s legitimate interest;
  • sending of commercial offers by e-mail:
    • to Customers, for products similar to those already purchased, on the basis of legitimate interest, the Customer being able to object at any time and free of charge, in particular via the unsubscribe link included in each message;
    • to other Users, only with their prior consent, obtained in particular when subscribing to the newsletter.

Data marked as mandatory in the forms is necessary to process the order or request. Without it, LUBIN will be unable to act on it.

4.3 – Data collected

LUBIN collects in particular: surname, first name, delivery and billing addresses, e-mail address, telephone number, order history and exchanges with customer service. Bank Details are processed directly by the secure payment provider Stripe; LUBIN does not have access to full bank card details.

4.4 – Recipients

The data is intended for LUBIN’s authorised departments. It may be disclosed, strictly as necessary, to its processors and partners: the Website host, payment provider, carriers, e-mailing tools, and to the consumer mediator in the event of a dispute. It may also be disclosed to the authorities where required by law. LUBIN does not sell or rent its Users’ data.

4.5 – Transfers outside the European Union

Where certain providers, in particular the payment provider, are located outside the European Union, LUBIN ensures that such transfers are subject to appropriate safeguards (adequacy decision of the European Commission or standard contractual clauses).

4.6 – Retention periods

  • Account and order data: for the duration of the commercial relationship, then archived for the applicable limitation period (5 years);
  • Accounting records and invoices: 10 years, in accordance with the French Commercial Code;
  • Data used for marketing purposes: 3 years from the last contact initiated by the User;
  • Bank card data: deleted once the transaction has been completed, unless retained by the payment provider as evidence in the event of a dispute, within the periods laid down by regulations (13 months, or 15 months for deferred debit cards).

4.7 – Users’ rights

Each User has the right of access, rectification, erasure, restriction and portability of their data, the right to object (in particular, at any time, to direct marketing), the right to withdraw consent where processing is based on consent, and the right to set out instructions regarding the handling of their data after their death.

These rights may be exercised by e-mail to eshop@lubin.eu or by post to LUBIN – Service client e-shop, 21 rue des Canettes, 75006 Paris, France. A response is given within one month. Proof of identity may be requested in the event of reasonable doubt as to the identity of the applicant.

The User may also lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL, the French data protection authority), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, www.cnil.fr.

5. Cookies and other trackers

LUBIN uses cookies and other trackers on the Website. Some are strictly necessary for the operation of the Website and the Services (basket, account login, security, storing cookie choices) and do not require consent.

Other cookies, in particular non-exempt audience measurement, personalisation or advertising cookies, are only placed with the User’s prior consent, obtained via the banner displayed on their first visit. The User may accept, refuse or configure these cookies, and change their choice at any time via the “Manage my cookies” link [to be provided in the footer]. Refusing these cookies does not prevent access to the Website.

The User may also block or delete cookies via their browser settings; however, blocking strictly necessary cookies may prevent the use of certain features, such as placing an order.

Details of the cookies used, their purposes and their retention periods are set out in the Cookie Policy available [link].

6. Intellectual property

The visuals, photographs, icons, texts, graphics, logos and trademarks on the Website are protected by copyright, trademark law and/or any other intellectual property right held by LUBIN or which it is authorised to use.

LUBIN grants Users a private, non-exclusive right to use such content, solely to the extent necessary to use the Website and the Services, and within the limits laid down in the General Terms and Conditions.

Any copying, reproduction or representation of all or part of the Website or its content is prohibited without LUBIN’s prior written consent, except for private and non-commercial use within the limits permitted by law. Any unauthorised reproduction or representation may constitute infringement and may give rise to legal proceedings.

7. Website continuity

LUBIN is bound only by an obligation of means as regards the accessibility and continuity of the Website. It does not guarantee that the Website will be accessible at all times, without interruption, suspension or error.

LUBIN reserves the right to suspend the operation of the Website, in particular for maintenance operations.

8. Miscellaneous

The General Terms and Conditions set out all the obligations of the Parties.

The fact that a Party does not rely on a breach of any of the obligations of the General Terms and Conditions shall not constitute a waiver of its right to rely on it subsequently.

If one or more provisions of the General Terms and Conditions are declared null or invalid by a law or a final court decision, the other provisions shall retain their full force and effect.

The General Terms and Conditions are drawn up in French and in English. In the event of any discrepancy, the French version shall prevail, subject to the mandatory provisions applicable to the consumer Customer.

9. Governing law – Disputes

The General Terms and Conditions are governed by French law, subject to the mandatory provisions of the law of the country of residence of the consumer User.

The procedures for complaints, recourse to consumer mediation and dispute resolution are set out in article III.10.

III. General Terms and Conditions of Sale

1. Customer capacity

Only adult natural persons with legal capacity may place orders and pay on the Website.

LUBIN is not required to verify the legal capacity of Customers, but reserves the right to request a copy of an identity document at any stage of the payment process.

The Customer undertakes that their orders bear no direct or indirect relation to any professional activity and are intended for strictly personal use.

2. Products

Product description

In accordance with article L111-1 of the Code de la consommation (French Consumer Code), the Customer may read on the Website, before placing any order, the essential characteristics of the Product they wish to purchase.

The photographs and illustrations of the Products are provided for guidance only and have no contractual value; slight differences in colour or presentation may exist. The essential characteristics stated on each Product page are binding on LUBIN.

Product availability

The Products are offered while stocks last. LUBIN reserves the right to withdraw Products from sale at any time.

If a Product becomes unavailable after the order has been placed, the Customer is informed by e-mail as soon as possible, together with the total or partial cancellation of their order:

  • in the event of total cancellation, the Customer is not charged or, if already charged, is refunded in full;
  • in the event of partial cancellation, the available Products are delivered and the price of the unavailable Products is refunded to the Customer without delay, and no later than fourteen (14) days after payment, using the means of payment used for the order.

3. Prices

Product prices are stated in euros, inclusive of all taxes. The applicable price is the one displayed on the Website on the day of the order.

Prices include the value added tax (VAT) applicable on the day of the order, according to the country of delivery. They do not include delivery charges, the amount of which is shown to the Customer before the order is validated and is added to the price of the Products.

For deliveries outside the European Union (Iceland, Liechtenstein, Norway, Switzerland), customs duties, import taxes and customs clearance fees may be charged on delivery by the authorities of the country of destination; they are payable by the Customer .

The total price, including delivery charges, is summarised before the order is validated and then restated in the order confirmation e-mail.

LUBIN reserves the right to change its prices at any time. Products are invoiced at the price in force when the order is validated.

4. Ordering

Placing an order

To place an order, the Customer follows these steps:

  • they select the Products and their quantity, then add them to their basket;
  • they check the contents of their basket;
  • they log in to their account or create one, entering in particular their surname, first name, e-mail address and postal address;
  • they enter the delivery address, located in one of the countries listed in article III.6, and choose the delivery method;
  • they read the summary of their order (Products, prices, delivery charges, total amount) and these General Terms and Conditions, which they accept;
  • they validate their order by clicking on the “Order with obligation to pay” button [or equivalent wording], then proceed to payment.

Until the order is validated, the Customer may return to the previous steps at any time to check or correct their order and identify any input errors.

Confirmation and final validation of the order

After payment has been validated, LUBIN sends the Customer, by e-mail, a summary of their order stating in particular the order number, the description and price of the Products, the delivery charges and the total amount including taxes.

The sale only becomes final once LUBIN has received the full price.

LUBIN then sends the Customer, on a durable medium, a final validation e-mail. This e-mail confirms receipt of full payment, reproduces these General Terms and Conditions, sets out the conditions, time limit and procedures for exercising the right of withdrawal and includes the model withdrawal form in Annex 1.

Refusal of orders

LUBIN may refuse any order in the event of total or partial non-payment of a previous order, or if the bank refuses payment authorisation.

LUBIN may also refuse any order of an abnormal nature, in particular with regard to the frequency of orders, the quantities ordered or their amount. As purchases on the Website are reserved for strictly personal use, the value of an order is capped at 830 euros including taxes; any order of a higher amount cannot be processed.

5. Payment

Terms

Payment is made when the order is placed, by Visa, MasterCard or American Express bank card, with 3D Secure authentication. The Customer enters their card number, expiry date, cardholder’s name and security code.

Payment is processed by Stripe, a secure payment provider. Bank Details are sent directly to Stripe and are neither stored by nor accessible to LUBIN.

Payments by cheque, as well as split or deferred payments, are not accepted.

The Customer warrants to LUBIN that they have the necessary authorisations to use the chosen means of payment. The order is automatically cancelled if the bank refuses payment.

The invoice is sent by e-mail to the e-mail address provided by the Customer when placing the order.

Fraud prevention

In order to combat Internet fraud, Stripe carries out checks on order information and stores and processes this information, including bank card details, in a secure environment.

In the event of non-payment resulting from the fraudulent use of a bank card, the information associated with the order may be entered in a fraud prevention file kept by Stripe. Any irregular declaration or anomaly may be subject to specific treatment.

6. Delivery

Countries and address of delivery

The Products are delivered to the address given by the Customer when ordering, in one of the following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, the Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Monaco, the Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and Switzerland.

Delivery times and charges

The delivery time and cost depend on the delivery method chosen by the Customer and are shown to them before the order is validated.

In accordance with article L216-1 of the Code de la consommation, where no time limit is stated, LUBIN delivers the Products no later than thirty (30) days after the conclusion of the contract.

A dispatch e-mail is sent to the Customer when their order is shipped. A delivery note setting out the conditions and procedures for returning the Products is enclosed with the parcel.

7. Receipt of the Products

On delivery, the Customer is invited to check the condition of the packaging and the conformity of the Products.

In the event of an apparent anomaly (damaged parcel, missing or damaged Product), the Customer is invited to make specific reservations on the carrier’s delivery note, then to inform LUBIN as soon as possible, if possible within ten (10) days of receipt, via the Website’s contact form or by e-mail to eshop@lubin.eu. These steps make it easier to process the complaint; they do not deprive the Customer of the legal guarantees provided for in article III.9.

LUBIN may carry out an investigation with the carrier to determine the cause of a delay or loss. If a missing Product is found, it is delivered to the Customer at the address given when ordering.

In the event of late delivery beyond the date or time limit stated, the Customer may require LUBIN, by e-mail to eshop@lubin.eu or by registered letter with acknowledgement of receipt sent to LUBIN – Service client e-shop, 21 rue des Canettes, 75006 Paris, France, to make the delivery within a reasonable additional period. If delivery is not made within that period, the Customer may terminate the contract under the conditions laid down in articles L216-6 et seq. of the Code de la consommation; LUBIN then refunds all sums paid no later than fourteen (14) days after termination.

8. Right of withdrawal and return of Products

8.1 – Period

In accordance with articles L221-18 et seq. of the Code de la consommation, the consumer Customer has a period of thirty (30) days to exercise their right of withdrawal, without having to give reasons for their decision or bear any costs other than those provided for in article 8.5. This period is more favourable than the statutory period of fourteen (14) days.

This period runs from the day on which the Products are received by the Customer or by a third party designated by them, other than the carrier. Where several Products ordered are delivered separately, it runs from receipt of the last Product. Where the period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

8.2 – Exception: perfumes and unsealed products

In accordance with article L221-28, 5° of the Code de la consommation, the right of withdrawal may not be exercised for goods which have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection.

Consequently, the right of withdrawal only applies to perfumes and cosmetic products on condition that the Product has not been opened and that its protective film (cellophane) or any other original seal is intact. Any Product whose seal has been removed or damaged by the Customer can be neither taken back nor refunded.

8.3 – How to exercise the right

Before the period expires, the Customer informs LUBIN of their decision to withdraw by one of the following means:

  • by using the online withdrawal function available on the Website [from the customer account and in the footer], entitled “Withdraw from the contract here” [wording to be confirmed];
  • by sending the model withdrawal form in Annex 1, by e-mail to eshop@lubin.eu or by post to LUBIN – Service client e-shop, 21 rue des Canettes, 75006 Paris, France;
  • by any other unequivocal statement expressing their wish to withdraw.

LUBIN acknowledges receipt of the withdrawal without delay, by e-mail on a durable medium. The burden of proof of exercising the right of withdrawal lies with the Customer.

8.4 – Return of the Products

The Customer returns the Products to LUBIN – Service client e-shop, 21 rue des Canettes, 75006 Paris, France, no later than fourteen (14) days after communicating their decision to withdraw. The Products must be returned complete, in their original packaging, with the seal intact for perfumes and cosmetics, together with any accessories and a copy of the invoice or the order number.

The Customer is advised to use a tracked shipping method and to insure their parcel. The risks of return transport are borne by the Customer.

The Customer may be held liable for any diminished value of the Products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

8.5 – Return costs

The direct costs of returning the Products are borne exclusively by the Customer.

8.6 – Refund

In the event of a valid withdrawal, LUBIN refunds all sums paid, including the initial delivery charges, no later than fourteen (14) days from the date on which it was informed of the decision to withdraw.

LUBIN may withhold the refund until it has received the Products back or until the Customer has supplied proof of having sent them, whichever is earlier.

Where the Customer has expressly chosen a delivery method more expensive than the standard delivery method offered, the difference in cost is not refunded.

The refund is made using the same means of payment as that used for the order, unless the Customer expressly agrees to another means, and at no cost to the Customer.

9. Legal guarantees

Irrespective of the right of withdrawal, all Products benefit from the legal guarantee of conformity provided for in articles L217-3 et seq. of the Code de la consommation and from the legal guarantee against hidden defects provided for in articles 1641 to 1649 of the Code civil (French Civil Code).

9.1 – Legal guarantee of conformity

The Customer has a period of two (2) years from delivery of the Product to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the Customer is only required to establish the existence of the defect, and not the date on which it appeared.

The legal guarantee of conformity entitles the Customer to the repair or replacement of the Product within thirty (30) days of the Customer’s request, free of charge and without major inconvenience to them. LUBIN may refuse the Customer’s choice if it is impossible or entails disproportionate costs compared with the other option.

The Customer may obtain a price reduction while keeping the Product, or terminate the contract and obtain a full refund in exchange for returning the Product, if LUBIN refuses to repair or replace the Product, if the repair or replacement does not take place within thirty (30) days, if the defect persists despite the attempt to bring the Product into conformity, or if the seriousness of the defect justifies an immediate price reduction or termination. The Customer is not entitled to termination if the lack of conformity is minor.

Any period during which the Product is immobilised with a view to its repair or replacement suspends the remaining guarantee period until the Product is delivered back in working order.

9.2 – Legal guarantee against hidden defects

The Customer may also take action under the guarantee against hidden defects within two (2) years of discovering the defect. The Customer may then choose between termination of the sale, with refund of the price in exchange for returning the Product, or a price reduction while keeping the Product, in accordance with article 1644 of the Code civil.

9.3 – Implementation

For any claim under the legal guarantees relating to an order placed on the Website, the Customer contacts LUBIN customer service as provided for in article III.10.1. Such claims cannot be handled by other LUBIN points of sale.

10. Complaints, mediation and disputes

10.1 – Prior complaint to LUBIN

For any complaint relating to an order, the Customer first contacts LUBIN customer service:

  • by e-mail: eshop@lubin.eu;
  • by post: LUBIN – Service client e-shop, 21 rue des Canettes, 75006 Paris, France.

LUBIN acknowledges receipt of the complaint and responds to it within thirty (30) days.

10.2 – Consumer mediation

In accordance with articles L611-1 et seq. and R612-1 et seq. of the Code de la consommation, in the event of an unresolved dispute, the consumer Customer may refer the matter free of charge to the consumer mediator to which LUBIN is subject:

MCF –Médiateur de la consommation FEVAD. BP 20015 – 75362 PARIS CEDEX 8 –

The matter may only be referred to the mediator if the Customer:

  • has first attempted to resolve the dispute directly with LUBIN by means of a written complaint, as provided for in article 10.1;
  • submits their request to the mediator within one (1) year of that written complaint;
  • does not submit a manifestly unfounded or abusive request;
  • has not already referred the dispute to another mediator or to a court.

The mediation is conducted in France by the mediator designated above, in accordance with the provisions of the Code de la consommation, including for Customers residing in another country. It is conducted in French [and, where applicable, in English] and may be carried out remotely, in particular online.

Mediation is optional: the Customer and LUBIN remain free to accept or refuse the solution proposed by the mediator. Recourse to mediation does not deprive the Customer of the right to bring proceedings before the competent courts.

10.3 – Cross-border disputes

Customers residing in another European country may also obtain free assistance from the European Consumer Centre of their country of residence (ECC-Net network), or from the European Consumer Centre France (www.europe-consommateurs.eu).

10.4 – Governing law

These General Terms and Conditions of Sale are governed by French law. However, in accordance with Regulation (EC) No 593/2008 known as “Rome I”, this choice may not deprive a consumer Customer residing in another country of the protection afforded to them by the mandatory provisions of the law of their country of residence.

10.5 – Jurisdiction

Failing an amicable settlement, and subject to the mandatory provisions applicable to consumers, disputes relating to these General Terms and Conditions of Sale fall within the jurisdiction of the French courts.

The consumer Customer nevertheless retains the right to bring proceedings, at their choice, before the court of the place where they resided at the time the contract was concluded or the damaging event occurred, or before the court of the place of delivery, as well as, if they reside in another Member State of the European Union, before the courts of their country of residence, in accordance with Regulation (EU) No 1215/2012 known as “Brussels I bis”.

11. Entire agreement

The General Terms and Conditions and the final order validation e-mail constitute the entire contractual relationship between the Parties relating to the sale of the Products.

Annex 1 – Model withdrawal form
